In response to the Board’s questions, Matt Mcguire, owner, stated that he is about one month closer to anticipating opening the restaurant; he was also the owner of King Louie’s Restaurant and will have the “Beggin Purse” on the new menu. Alderman Winings moved to approve a liquor license for Louie DeMun. Alderman Boulton seconded. The motion passed unanimously on a voice vote. Mayor Sanger opened the public hearing and requested proof of publication. City Manager Owens reported that this is an ordinance approving a major subdivision plat. The plat consolidates the seven lots referenced above and a vacated alley into two lots. The consolidated lots measure 48,791 and 58,165 square feet. On May 26, 2017, the City of Clayton received an application and plat from Stock & Associates, consulting engineer on behalf of Centene Center II, LLC, for the approval of a subdivision plat to be known as Centene Plat II. The plat is in conjunction with the Centene Clayton Campus Development Sub-district 2 (a, b & c). The Plan Commission considered this plat at their meeting of July 17, 2017 and recommended approval.

Mayor Sanger called the meeting to order and requested a roll call. The following individuals were in attendance:

Alderman Boulton moved to approve the July 25, 2017 minutes. Alderman Berger seconded. The motion passed unanimously on a voice vote. PUBLIC REQUESTS AND PETITIONS

Mayor Sanger read the following statement: “It was just 5 months ago following the desecration of a local Jewish cemetery that I read a statement on behalf of the Clayton Board of Aldermen denouncing hate, bigotry and discrimination. Now sadly, new events require us to once again restate unequivocally and in the loudest possible voice that there is no place in our country, in our state or in our city for the violence, bigotry and lawlessness that occurred in Charlottesville, VA. The actions by the KKK, White Supremacists, Neo Nazis and others of their ilk is repugnant, despicable and un-American. Our fellow Americans who fought ways to preserve our liberty did so to eliminate the fascism and hate that these groups embrace, and we denounce them and their purpose.”

A MOTION TO CONSIDER A LIQUOR LICENSE FOR THE BOX HILL GROUP, LLC D.B.A. LOUIE DEMUN LOCATED AT 706 DEMUN AVE., SUITE B

City Manager Owens reported that Box Hill Group, LLC d.b.a. Louie Demun is requesting a liquor license to sell all kinds of intoxicating liquor at retail by the drink, including Sundays, at 706 Demun Ave., Suite B. The Police Department has completed its review of the application and supports the issuance of the requested license. The Planning and Development department has also approved the application with no objections. The applicant has chosen not to submit a petition from surrounding property owners and first floor tenants. As a result, they are aware that this application must have a super majority vote of five Board members to be approved. Staff has requested that a representative attend the meeting.

The plat is in conjunction with the Centene Clayton Campus Development Sub-district 2 (a, b & c). The Plan Commission considered this plat at their meeting of July 17, 2017 and recommended approval. Following the meeting, the applicant made minor adjustments fromthe plat that was presented to the Plan Commission, and the matter now comes before you with those minor adjustments included. They are as follows: The eastern property line of proposed Lot 1 is now 201.19’ long, whereas it was 201.56. Lot 1 is now 48,700 square feet versus 48,791 square feet (a reduction of 91 square feet)

Lot 2 is now 58,256 square feet versus 58,165 square feet (an increase of 91 square feet)

The intent remains the same, and the square footages and acreage change is very minimal. These changes have been reviewed by the City Attorney who has determined that they are de minimus and should not require reconsideration by the Plan Commission. Recommendation is to approve the ordinance. Alderman Winings recused himself from the meeting at 7:04 p.m. Mayor Sanger closed the public hearing. Alderman Boulton introduced Bill No. 6626, an ordinance to consider approving a subdivision plat for 7528, 7634, 7520, 7518, & 7510 Forsyth Boulevard; 10 South Lyle Avenue; 101 & 105 Carondelet Plaza to be read for the first time by title only. Alderman Berger seconded.

The motion passed unanimously on a voice vote. Alderman Boulton moves that the Board give unanimous consent to consideration for adoption of Bill No. 6626 on the day of its introduction. Alderman Berger seconded. The motion passed unanimously on a voice vote. Alderman Boulton introduced Bill No. 6626, an ordinance to consider approving a subdivision plat for 7528, 7634, 7520, 7518, & 7510 Forsyth Boulevard; 10 South Lyle Avenue; 101 & 105 Carondelet Plaza to be read for the second time by title only. Alderman Berger seconded. The motion passed on a roll call vote: Alderman Boulton – Aye; Alderman Berger– Aye; Alderman Lintz – Aye; Alderman Berkowitz – Aye; Alderman Harris – Aye; and Mayor Sanger – Aye. The bill was adopted and became Ordinance No. 6494 of the City of Clayton.
