Minutes

Mayor Sanger called the meeting to order and requested a roll call. The following individuals were in attendance:

Aldermen: Mark Winings, Joanne Boulton, Alex Berger, Rich Lintz, Ira Berkowitz, and Michelle Harris

Alderman Boulton moved to approve the July 25, 2017 minutes. Alderman Berger seconded.

The motion passed unanimously on a voice vote.

PUBLIC REQUESTS AND PETITIONS

Mayor Sanger read the following statement: “It was just 5 months ago following the desecration of a local Jewish cemetery that I read a statement on behalf of the Clayton Board of Aldermen denouncing hate, bigotry and discrimination. Now sadly, new events require us to once again restate unequivocally and in the loudest possible voice that there is no place in our country, in our state or in our city for the violence, bigotry and lawlessness that occurred in Charlottesville, VA. The actions by the KKK, White Supremacists, Neo Nazis and others of their ilk is repugnant, despicable and un-American. Our fellow Americans who fought ways to preserve our liberty did so to eliminate the fascism and hate that these groups embrace, and we denounce them and their purpose.”

A MOTION TO CONSIDER A LIQUOR LICENSE FOR THE BOX HILL GROUP, LLC D.B.A. LOUIE DEMUN LOCATED AT 706 DEMUN AVE., SUITE B

City Manager Owens reported that Box Hill Group, LLC d.b.a. Louie Demun is requesting a liquor license to sell all kinds of intoxicating liquor at retail by the drink, including Sundays, at 706 Demun Ave., Suite B.

The Police Department has completed its review of the application and supports the issuance of the requested license. The Planning and Development department has also approved the application with no objections.

The applicant has chosen not to submit a petition from surrounding property owners and first floor tenants. As a result, they are aware that this application must have a super majority vote of five Board members to be approved. Staff has requested that a representative attend the meeting.

In response to the Board’s questions, Matt Mcguire, owner, stated that he is about one month closer to anticipating opening the restaurant; he was also the owner of King Louie’s Restaurant and will have the “Beggin Purse” on the new menu.

Alderman Winings moved to approve a liquor license for Louie DeMun. Alderman Boulton seconded.

The motion passed unanimously on a voice vote.

A PUBLIC HEARING – AN ORDINANCE TO CONSIDER APPROVING A SUBDIVISION PLAT FOR 7528, 7634, 7520, 7518, & 7510 FORSYTH BOULEVARD; 10 SOUTH LYLE AVENUE; 101 & 105 CARONDELET PLAZA (CENTENE PLAT II)

Mayor Sanger opened the public hearing and requested proof of publication.

City Manager Owens reported that this is an ordinance approving a major subdivision plat. The plat consolidates the seven lots referenced above and a vacated alley into two lots. The consolidated lots measure 48,791 and 58,165 square feet.

On May 26, 2017, the City of Clayton received an application and plat from Stock & Associates, consulting engineer on behalf of Centene Center II, LLC, for the approval of a subdivision plat to be known as Centene Plat II. The plat is in conjunction with the Centene Clayton Campus Development Sub-district 2 (a, b & c). The Plan Commission considered this plat at their meeting of July 17, 2017 and recommended approval. Following the meeting, the applicant made minor adjustments fromthe plat that was presented to the Plan Commission, and the matter now comes before you with those minor adjustments included. They are as follows: The eastern property line of proposed Lot 1 is now 201.19’ long, whereas it was 201.56.

Lot 1 is now 48,700 square feet versus 48,791 square feet (a reduction of 91 square feet)

Lot 2 is now 58,256 square feet versus 58,165 square feet (an increase of 91 square feet)

The intent remains the same, and the square footages and acreage change is very minimal.

These changes have been reviewed by the City Attorney who has determined that they are de minimus and should not require reconsideration by the Plan Commission.

Recommendation is to approve the ordinance.

Alderman Winings recused himself from the meeting at 7:04 p.m.

Alderman Boulton moves that the Board give unanimous consent to consideration for adoption of Bill No. 6626 on the day of its introduction. Alderman Berger seconded.

Alderman Winings rejoined the meeting at 7:07 p.m.

A PUBLIC HEARING TO CONSIDER AN ORDINANCE SETTING THE TAX YEAR 2017 PROPERTY TAX LEVIES FOR FISCAL YEAR 2018 BUDGET (FIRST READING)

Mayor Sanger opened the public hearing and requested proof of publication.

City Manager Owens reported that as part of the property tax levy process, the Board will hold a public hearing to seek public input on the proposed tax rates.

Thus the City’s maximum levies this year are projected to generate the amount of revenue from the previous year, plus CPI and revenue related to a small amount of new construction, plus the amount available for recoupment. The recoupment process appears to have less of an effect on rates this year than last year. The levies as presented are subject to change by the Board of Equalization and through the Missouri State Auditor’s certification process, therefore there is the potential for the rates to still change slightly. If this occurs, staff will inform you of our options at that time.

The General Fund tax levy, which may be used for any general purpose, is projected to generate nearly $6.2 million, or approximately $50,000 less than last year. The City also has a levy to support the debt service of the police building. This levy was approved by voters in 2010 and implemented in 2013 when a previous general obligation bond issue matured. This levy will generate $1.4 million which is higher than last year and will allow us to build a small reserve for this fund.

In 2014 the City issued voter approved general obligation bonds, supported by property tax which will generate nearly $1.2 million, slightly more than last year.

For a home valued at $700,000, it is expected that the homeowner would pay approximately $1,097 in property taxes for the City of Clayton portion only. Based on last year’s rate, the same homeowner would pay $64 less than last year, assuming the assessed value remained the same.

A commercial property, located in the Special Business District assessed at $2.0 million would pay approximately $742 in property taxes for the Special Business District portion only. Based on last year’s rate, the same commercial property would pay approximately $275 less last year, assuming the assessed value remained the same.

Recommended action is to have a first reading of an ordinance setting the annual property tax rates for calendar year 2017 (Fiscal Year 2018).

Alderman Winings introduced Bill No. 6627, an ordinance to consider approving the property tax levies for Tax Year 2017 to be read for the first time by title only. Alderman Boulton seconded.

City Attorney O’Keefe reads Bill No. 6627, an Ordinance Levying and Establishing the Rate of Annual Taxes for General Municipal Purposes; Police Building Debt Service; General Obligation Debt Service; and Special Business District Purposes to be Collected by the City of Clayton, Missouri, for the Year 2017 for the first time by title only.

The motion passed unanimously on a voice vote.

A PUBLIC HEARING – AN ORDINANCE TO CONSIDER THE PROPOSED FISCAL YEAR 2018 OPERATING AND CAPITAL IMPROVEMENTS BUDGET (First Reading)

Mayor Sanger opened the public hearing and requested proof of publication.

City Manager Owens reported that in July, the Board of Aldermen received the City Manager’s proposed Fiscal Year 2018 Operating and Capital Improvements Budget. As part of the budget process, the Board is required to hold a public hearing to seek public input prior to formal budget adoption. The public hearing will occur at the Board of Aldermen meeting on August 22, 2017.

The Board extensively reviewed the proposed budget during public meetings on July 18 and August 18, 2017.

We believe the proposed budget maintains the extraordinary level and proficiency of service that has been expected by our residents and traditionally provided by the City. The Board of Aldermen has studied this proposed budget and the public has had opportunity for input. The attached ordinance approving the Fiscal Year 2018 Operating and Capital Improvements Budget is presented for first reading. When the budget is presented for final approval, as in past years we will provide a reconciliation of any changes since the proposed budget.

Recommended actions is to conduct a public hearing and have the first reading of the Fiscal Year 2018 Operating and Capital Improvements Budget as presented in the proposed budget.

Alderman Berger commended the staff on a job well done.

Alderman Winings introduced Bill No. 6628, an ordinance to adopting the FY2018 Operating and Capital Improvement Budget to be read for the first time by title only. Alderman Boulton seconded.

City Attorney O’Keefe reads Bill No. 6628, an Ordinance Adopting an Annual Budget for Fiscal Year 2018 Commencing on October 1, 2017 and Appropriating Funds Pursuant Thereto for the first time by title only.

The motion passed unanimously on a voice vote.

A RESOLUTION TO AUTHORIZE THE SUBMITTAL OF A MUNICIPAL PARKS GRANT APPLICATION FOR THE ICE RINK IN SHAW PARK

City Manager Owens reported that Included in the FY 2018 and FY2019 capital budget is funding for the replacement of the Shaw Park Ice Rink. This new year-round multi-use facility will serve as an outdoor ice rink in the winter months, and be converted to a tennis and field facility the remainder of the year. This project will include the construction of a new building to serve the year-round needs of the site, a new Ice Rink as well as an enhanced park area and drop off for the facility. The City intends to apply for a two-year grant to help fund the rink itself.

Included in the Capital Budget is funding for this $7 million project; the majority of which will be funded through the issuance of bonds to be paid back through the Parks and Stormwater tax revenues. The City is eligible for up to $420,000 of grant funding for each of the next two years and will be applying for a multi-year grant to fund the installation of the skating surface and associated equipment. This component of the project has an estimated cost of $1,500,000 so this is a reasonable component to fund through the grant.

Recommendation is to approve the resolution authorizing submittal of the grant application for the Ice Rink in Shaw Park.

In response to Alderman Berkowitz’ question, City Manager Owens confirmed that the Board is required to approve some grant applications depending on the agency’s grant requirements.

In response to Alderman Harris’ question, Patty DeForrest stated that the source of the grant monies comes from certain sales tax through St. Louis County. She added that the Board approved resolution shows support of the proposed project.

Alderman Winings moved to approve Resolution No. 17-15, authorizing the submittal of a grant application for the Shaw Park Ice Rink. Alderman Boulton seconded.

UPDATE ON THE STATUS OF ONGOING PROJECTS (CRAIGSLIST)

City Manager Owens provided an update the Board on significant projects that staff plans to complete in the next twelve months. The list of projects currently has more than 100 items and is organized by the staff member responsible for implementation. The projects included are in progress and completed projects are removed from the list.

Other

Alderman Boulton and Alderman Harris reported that they attended the Chamber Power Hour luncheon today and heard an update on the Gateway Arch Park Foundation. There are great things happening including a marketing strategy, renovations have stimulated growth and activities in the area. Alderman Harris added that Sarah Mellinger, Clayton resident and member of the Clayton Century Foundation, is employed with the Foundation and oversees their fundraising. Alderman Boulton added that there are a lot of events planned, one of which is a planned blues festival.

Alderman Berger reported on the following: • The Non-Uniformed and Uniformed Pension Boards; both are continuing to exceed goals on an annual basis and hold very strong positions financially. The Boards are planning on meeting with the Board of Aldermen to provide an update. • The 24th Annual St. Louis Art Fair is scheduled September 8-10th, 181 artists; expecting 131,000 attendees; free parking at the Centene garage will be available to visitors.

Alderman Berkowitz that the CRSWC provided a quarterly report at their last meeting.

Alderman Harris reported that CCF met last week; they are currently doing some “strong” fundraising; they have appointed a new slate of officers; monies are being raised for the Family Center Playground project.

City Manager Owens recognized Jessica Macheta, reporter for the ClaytonTimes, in the audience.

Mayor Sanger reported on the following: • Participated in a tour of the Kaldi’s Coffee facility with the Summer Associates. • Attended the grand opening of Bates Architect Company. • Attended of end-of-summer kids event at the International Institute of St. Louis. The organization helps immigrants and their families become productive Americans and champion ethnic diversity as a cultural and economic strength. They also provide a free summer program for the children. • Attended the Chamber Power Hour luncheon. • Visited Clementine’s on DeMun; lots of citizen activity.

Alderman Boulton added that she watched the eclipse at Jefferson Barracks Park; County Executive Stenger sang the National Anthem.

Alderman Harris announced that Shakespeare in the Street will be having an event, “One City” in the City of St. Louis.

Alderman Harris moved that the Board adjourn to a closed meeting, with a closed vote and record, as authorized by Section 610.021(1), (2) and (3) Revised Statutes of Missouri, relating to legal issues, real estate and/or personnel, and to discuss matters related to
