Board of Aldermen Executive Session July 26, 2022 6:30 p.m.

Present/In-person: Aldermen: Bridget McAndrew, Susan Buse, Gary Feder, Mayor Harris, City Manager Gipson, City Attorney O’Keefe.

Virtual attendance: Alderman Ira Berkowitz

Motion made by Alderman Feder that the Board adjourn to a closed meeting, with a closed vote and record, as authorized by Section 610.021(1), (2) and (3) Revised Statutes of Missouri, relating to legal issues, real estate and/or personnel, and to discuss matters related to negotiation of a contract pursuant to Section 610.021(12), RSMo. and/or proprietary information pursuant to Sec. 610.021(15), and/or information related to public safety and security measures pursuant to Section 610.021(18) and (19) RSMO. Alderman Buse seconded.

The motion passed on a roll call vote: Alderman Berkowitz – Aye; Alderman McAndrew – Aye; Alderman Buse – Aye; Alderman Feder – Aye; and Mayor Harris – Aye.

Board of Aldermen In-Person and Virtual Meeting July 26, 2022 7:04 p.m.

Minutes

The meeting was open to individuals to attend in-person and/or virtually via Zoom.

Mayor Harris called the meeting to order and requested a roll call. The following individuals were in attendance:

In-person: Aldermen: Bridget McAndrew, Susan Buse, Gary Feder, Mayor Harris, City Manager Gipson, City Attorney O’Keefe, and City Clerk Frazier

Staff: Assistant City Manager Muskopf

Virtually: Aldermen Ira Berkowitz and Anna Krane, Director of Planning

Absent: Aldermen: Rich Lintz and Becky Patel

Motion made by Alderman McAndrew to approve the July 12, 2022, minutes. Alderman Berkowitz seconded.

Motion to approve the minutes passed unanimously on a voice vote.

PUBLIC REQUESTS AND PETITIONS

None

A PUBLIC HEARING AND A RESOLUTION TO CONSIDER APPROVING A CONDITIONAL USE PERMIT FOR 7529 FORSYTH BOULEVARD

Mayor Harris opened the public hearing and requested proof of publication.

City Manager Gipson reported that this is a public hearing and resolution approving an application for a Conditional Use Permit submitted by 7529 Forsyth LLC, owner, to allow the restoration of two residential units in the existing building.

The subject property is zoned C-2 General Commercial District and is located in the Forsyth Station TOD. Multi-family residential uses are allowable in the Forsyth Station TOD as part of a mixed-use building provided a Conditional Use Permit is approved by the Board of Aldermen.

Anna Krane, Director of Planning, was present (virtually) to answer questions.

Monica Saleeby, owner, was present (in-person) to address the Board and answer questions.

Mayor Harris closed the public hearing.

Alderman Berkowitz moved to approve Resolution No. 2022-16, a Conditional Use Permit for 7529 Forsyth Boulevard. Alderman McAndrew seconded.

The motion passed unanimously on a voice vote.

AN ORDINANCE TO CONSIDER APPROVING AN AGREEMENT WITH MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION FOR THE CENTRAL BUSINESS DISTRICT (CBD) RESURFACING PHASE 2 PROJECT

City Manager Gipson reported that in February of 2021, the City of Clayton applied for a grant from the East-West Gateway Council of Governments to resurface portions of the Central Business District (N. Brentwood Blvd, Central Avenue, Bemiston Avenue, and Carondelet Avenue) for the third year in a row. The project qualified for funding through the Surface Transportation Program. The project also includes portions of S. Bemiston Avenue and Carondelet Avenue that are not eligible for grant reimbursement.

Matt Malick, Director of Public Works, addressed the Board to answer questions.

Concerns were raised regarding the brick crosswalks and the costs related.

Motion made by Alderman Berkowitz to table Bill No. 6905, an agreement with MoDOT for the Central Business District Resurfacing Phase 2 Project until additional information could be gathered. Alderman McAndrew seconded.

The motion passed unanimously on a voice vote.

A RESOLUTION TO CONSIDER READOPTING PROCEDURE TO DISCLOSE POTENTIAL CONFLICTS OF INTEREST

City Manager Gipson in 1991, the Missouri General Assembly adopted the ethics/personal financial disclosure law, which affects municipalities with an annual operating budget in excess of $1 million. The ethics legislation allowed political subdivisions to establish their own method of disclosing potential conflicts of interest and substantial interests. Accordingly, pursuant to Section 105.485 of the Missouri Revised Statutes, on August 13, 1991, the City adopted by ordinance its own simplified personal financial disclosure requirements.

According to Section 105.485.4, RSMo., the Missouri Ethics Commission requires each affected municipality to readopt the personal financial disclosure ordinance in an open meeting biennially by September 15th.

Motion made by Alderman Berkowitz to approve Resolution No. 2022-17, Readopting Procedure to Disclose Potential Conflicts of Interest. Alderman McAndrew seconded.

The motion passed unanimously on a voice vote.

RECOMMENDATION FROM THE MAYOR’S COMMEMORATIVE LANDSCAPE TASK FORCE

City Manager Gipson reported that at the last meeting the Mayor and Board of Aldermen received a recommendation from the Mayor’s Commemorative Landscape Task Force to commemorate the African American history of Clayton. It is recommended that the city utilize a multi-dimensional, phased approach to the remembrance of the Black history of Clayton by

working with the Clayton Community Foundation, City staff, and appropriate committees and commissions as determined by the Board of Aldermen.

Members of the Mayor’s Commemorative Landscape Task Force, Donna Rogers Beard (virtual), Geoff Ward (virtual), and Chris Schmiz (in-person) were in attendance to answer questions.

Motion made by Alderman Berkowitz to accept the recommendation of the Mayor’s Commemorative Landscape Task Force. Alderman McAndrew seconded.

The motion passed unanimously on a voice vote.

COMMUNITY ENGAGEMENT

City Manager Gipson reported that the Board of Aldermen discussed the upcoming community engagement effort and survey methodology at the July 12, 2022 meeting. Staff was directed to seek an opinion from a research firm to determine the best approach. After consultation with a local survey methodology expert, it was determined that a combination of traditional survey and online engagement tools would be the most effective. It would yield statistically significant survey results (traditional survey), educate the public (engagement tool) and provide answers with greater context (engagement tool). It was also emphasized that we should seek an outside review of the survey questions.

Historically, the City has solely utilized traditional randomized mail surveys to gather community input. The estimated cost for a traditional survey to determine service level and tax rate preferences is $11,450. In addition to a traditional mail survey, staff is recommending the purchase of the Balancing Act platform for online engagement. Balancing Act will have an annual cost of $5,800.

The City will also be using a platform called Bang the Table for ongoing community engagement and general communications. It has already been purchased as a part of our Communications budget and the Clayton-specific site will be built over the next several weeks. It will play a big role in the upcoming Parks/Bike Master Plan and the Comprehensive Plan initiatives.

David Berland, resident, (virtually) addressed the Board with a question regarding “Bang the Table.”

The Board was in consensus for staff to move forward.

OTHER

Alderman Berkowitz reported on the following: • Participated in a Chamber event on a tutorial of pickleball in Forest Park.

Alderman Feder reported on the following: • Attended the DeMun Mural event.

City Manager Gipson reported that the Redistricting Commission met recently and submitted their recommendations. City Attorney O’Keefe will provide an overall informational review at the August 9, 2022 meeting. The Commission recommendations will be presented to the Board at

the August 23, 2022, meeting during a public hearing. Public hearing notices will be published to run three (3) consecutive weeks prior to the August 23, 2022 meeting.

Motion made by Alderman Berkowitz to adjourn the meeting. Alderman McAndrew seconded.

The motion passed unanimously on a voice vote.
