Board of Aldermen In-Person and Virtual Meeting September 13, 2022 7:05 p.m.

Minutes

The meeting was open to individuals to attend in-person and/or virtually via Zoom.

Mayor Harris called the meeting to order and requested a roll call. The following individuals were in attendance:

In-person: Aldermen: Rich Lintz, Bridget McAndrew, Susan Buse, Becky Patel, Gary Feder, Mayor Harris, and City Attorney O’Keefe

Staff: Assistant City Manager Muskopf and Anna Krane, Director of Planning and Development

Virtually: Aldermen Berkowitz, City Manager Gipson, and City Clerk Frazier

Motion made by Alderman McAndrew to approve the August 23, 2022, minutes. Alderman Berkowitz seconded.

Motion to approve the minutes passed unanimously on a voice vote.

PUBLIC REQUESTS AND PETITIONS

None

RECOGNITIONS AND AWARDS

Dr. Joseph Schafer, St. Louis University Professor and Commissioner with the Commission on Accreditation for Law Enforcement Agencies (CALEA) presented to the Board the CALEA reaccreditation of the Clayton Police Department.

Chief Mark Smith, Captain Mark Seagle, and Lieutenant Jack Abell were present.

A PUBLIC HEARING AND A RESOLUTION TO CONSIDER APPROVING THE TRANSFER OF A CONDITIONAL USE PERMIT FOR 7610 WYDOWN BOULEVARD TO BE KNOWN AS BAR MORO

Mayor Harris opened the public hearing and requested proof of publication.

City Manager Gipson reported that this is a public hearing to consider an application for a Conditional Use Permit Transfer submitted by Ben Poremba of Bar Moro, LLC, restaurant owner, to allow for the operation of an approximately 1,009 square foot restaurant to be known as Bar Moro. The previous restaurant, known as Billie-Jean, has been closed for an extended period of time and therefore staff has decided to present the transfer request to the Board of Aldermen for final approval in accord with the discretion authorized by Sec. 405.860(D) of the City Code.

Ben Parembo, owner, was in attendance to answer questions.

Mayor Harris closed the public hearing.

Motion made by Alderman Lintz to approve Resolution No. 2022-19, granting the transfer of the Conditional Use Permit for 7610 Wydown Boulevard, Bar Moro. Alderman Berkowitz seconded.

The motion passed unanimously on a voice vote.

A MOTION TO CONSIDER A LIQUOR LICENSE FOR BAR MORO, LLC AT 7610 WYDOWN BOULEVARD

City Manager Gipson reported that Bar Moro, LLC is requesting a liquor license to sell all kinds of intoxicating liquor at retail by the drink, except Sundays, at 7610 Wydown Boulevard.

Motion made by Alderman Lintz to approve a liquor license for Bar Moro located at 7610 Wydown Boulevard. Alderman Berkowitz seconded.

The motion passed unanimously on a voice vote.

PUBLIC HEARING AND A RESOLUTION TO ACCEPT THE REPORT AND RECOMMENDATION OF THE 2022 REDISTRICTING COMMISSION

Public hearing remains open from the August 23, 2022 Board of Aldermen meeting.

City Manager Gipson reported that this is a resolution to consider approving the recommendation from the Redistricting Commission regarding redistricting the City’s Ward boundaries. During the meeting on August 23, 2022, the Board of Aldermen heard from the public and discussed the recommendation from the Redistricting Commission. Another ward boundary, Option E, was introduced during the meeting for review by the Board of Aldermen and the public. The resulting population distribution from Option E is as follows:

17,357 7.4%

Ideal Population = 5,785.67 Maximum Total Deviation < 10%

Alderman Lintz thanked the Redistricting Commission for their work. He stressed the importance of preparing in advance, especially communication for upcoming changes to more residences (specifically) in Ward 3, understanding that the city does not have to wait for 10 years when the next Census comes out to identify and begin to make those changes. He expressed his support for Option E.

Motion made by Alderman Lintz to amend Bill No. 6908 with the map designated Option E appended as Exhibit A. Aldermen Berkowitz seconded.

The motion passed unanimously on a voice vote.

Alderman Lintz introduced Bill No. 6908, an ordinance (amended to include Exhibit A), to accept the proposed boundary adjustment, Option E, as recommended by the Redistricting Commission to be read for the first time by title only. Alderman Berkowitz seconded.

City Attorney O’Keefe reads Bill No. 6908, first reading, an Ordinance Adopting New Ward Boundaries for the City of Clayton, Missouri, and Providing for an Effective Date for Same by title only.

The motion passed unanimously on a voice vote.

Motion made by Alderman Lintz that the Board give unanimous consent to consideration for adoption of Bill No. 6908 on the day of its introduction. Alderman Berkowitz seconded.

The motion passed unanimously on a voice vote.

Alderman Lintz introduced Bill No. 6908, an ordinance (amended to include Exhibit A), to accept the proposed boundary adjustment, Option E, as recommended by the Redistricting Commission to be read for the second time by title only. Alderman Berkowitz seconded.

City Attorney O’Keefe reads Bill No. 6908, second reading, an Ordinance Adopting New Ward Boundaries for the City of Clayton, Missouri, and Providing for an Effective Date for Same by title only.

The motion passed on a roll call vote: Alderman Lintz – Aye; Alderman Berkowitz – Aye; Alderman McAndrew – Aye; Alderman Buse – Aye; Alderman Patel – Aye; Alderman Feder – Aye; and Mayor Harris – Aye. The bill, having received majority approval was adopted and became Ordinance No. 6769 of the City of Clayton.

A PUBLIC HEARING AND AN ORDINANCE TO CONSIDER SETTING THE TAX YEAR 2022 PROPERTY TAX LEVIES FOR FISCAL YEAR 2023 BUDGET – 1ST READING

Mayor Harris opened the public hearing and requested proof of publication.

City Manager Gipson reported that as part of the property tax levy process, the Board will hold a public hearing to seek public input on the proposed tax rates. City Manager Gipson provided a PowerPoint© presentation of the proposed tax levies.

Karen Dilber, Director of Finance, was present to answer questions.

Alderman Lintz introduced Bill No. 6911, an ordinance to approve the Property Tax Levies for Tax Year 2022 (FY2023) to be read for the first time by title only. Alderman Berkowitz seconded.

City Attorney O’Keefe reads Bill No. 6911, first reading, An Ordinance Levying and Establishing the Rate of Annual Taxes for General Municipal Purposes; Police Building Debt Service; General Obligation Debt Service; and Special Business District Purposes to be Collected by the City of Clayton, Missouri, for the Year 2022 by title only.

The motion passed unanimously on a voice vote.

A PUBLIC HEARING AND AN ORDINANCE TO CONSIDER APPROVING THE PROPOSED FISCAL YEAR 2023 OPERATING AND CAPITAL IMPROVEMENTS BUDGET—1ST READING

Mayor Harris opened the public hearing and requested proof of publication.

City Manager Gipson reported that In July, the Board of Aldermen received the City Manager’s proposed Fiscal Year 2023 Capital Improvements Budget, and in August the Board received the proposed Fiscal Year 2023 Operating Budget. As part of the budget process, the Board is required to hold a public hearing to seek public input prior to formal budget adoption. City Manager Gipson provided a PowerPoint© presentation of the proposed budget.

Karen Dilber, Director of Finance, was present to answer questions.

Alderman Lintz introduced Bill No. 6912, an ordinance to approve the FY2023 Operating and Capital Improvement Budget to be read for the first time by title only. Alderman Berkowitz seconded.

City Attorney O’Keefe reads Bill No. 6912, first reading, an Ordinance Adopting an Annual Budget for Fiscal Year 2023 Commencing on October 1, 2022 and Appropriating Funds Pursuant Thereto an Ordinance Adopting an Annual Budget for Fiscal Year 2023 Commencing on October 1, 2022 and Appropriating Funds Pursuant Thereto by title only.

The motion passed unanimously on a voice vote.

A RESOLUTION TO CONSIDER APPROVING THE FY2023 CLAYTON RECREATION, SPORTS AND WELLNESS COMMISSION (CRSWC) BUDGET FOR THE CENTER OF CLAYTON

City Manager Gipson reported that presented tonight is the proposed Fiscal Year 2023 CRSWC Budget for the Center of Clayton. The budget includes revenues and expenses for the period October 1, 2022, through September 30, 2023, for the three CRSWC Funds --- Operating, Equipment Replacement and Capital. The Clayton Recreation, Sports and Wellness Commission considered this budget on August 26, 2022, and approved it as proposed. On September 7, 2021, the budget was presented at the Joint Meeting of the Board of Aldermen and Board of Education.

Toni Siering, Director of Parks and Recreation attended the meeting (virtually) to answer questions.

Motion made by Alderman Lintz to approve Resolution No. 2022-20, the CRSWC FY2023 Budget. Alderman Berkowitz seconded.

The motion passed unanimously on a voice vote.

Alderman Lintz commented on the St. Louis Art Fair – great event.

Alderman Berkowitz reported on the following: • Plan Commission/ARB • Thanks to Toni Siering on a great job on the CRSWC budget.

Alderman McAndrew reported on the following: • CRSWC meeting – audit presentation by Rubin Brown • Parks & Recreation Commission

Alderman Buse reported on the following: • Parks & Recreation Commission • Clayton Equity Commission o Discussion on the restrictive covenants o Discussion on affordable housing

Alderman Feder reported on the following: • St. Louis Art Fair • Thanks to Toni Siering on a great presentation of the CRSWC budget • Attended the Board of Adjustment meeting last week and commended Chairman Gary Soule and Board on the work that they do • Acknowledged his 1st anniversary as a member of the Board of Aldermen

Alderman Patel thanked the Parks & Recreation staff, Patrick McGee and David Wiley for a great job with the youth soccer and having two refs. She is an assistant coach for a team.

Mayor Harris reported on the following: • St. Louis Art Fair • Attended the groundbreaking ceremony for the Marriot Hotel • The BOA/BOE Breakfasts have been scheduled for the 2022-2023 year

Motion made by Alderman Lintz to adjourn the meeting. Alderman Berkowitz seconded.
