THE CITY OF CLAYTON

Board of Aldermen In-Person and Virtual Meeting June 27, 2023 7:00 p.m.

Minutes

The meeting was open to individuals to attend in-person and/or virtually via Zoom.

Mayor Harris called the meeting to order and requested a roll call. The following individuals were in attendance:

In-person: Ira Berkowitz, Bridget McAndrew, Susan Buse, Gary Feder, Rick Hummell, and Mayor Harris.

Absent: Becky Patel

Staff: City Manager Gipson, City Attorney Karr, City Clerk Frazier, and Assistant City Manager Andrea Muskopf

PUBLIC REQUESTS AND PETITIONS

Gail Elble, 8117 Pershing, addressed the Board with concerns of property maintenance of a neighboring property.

AN ORDINANCE FOR A SUBDIVISION PLAT (LOT CONSOLIDATION) FOR 8220 – 8260 FORSYTH BOULEVARD

Mayor Harris opened the public hearing and requested proof of publication.

City Manager Gipson reported that the Board of Aldermen approved the rezoning, Planned Unit Development, and lot consolidation plat for the subject properties on June 14, 2022. Conditions of the consolidation plat included that the mylar was recorded within 30 days of Board of Aldermen approval. The developers did not close on the sale of the properties within this time and did not complete the recording of the plat. The previous approval of the plat has expired, and the applicant is requesting approval again. The proposed plat and associated development have not changed since the previous approval.

The Plan Commission considered this request on June 20, 2023, and voted unanimously to recommend approval to the Board of Aldermen.

Steve Metherd, Developer, was in attendance to answer questions.

Mayor Harris closed the public hearing.

Alderman Berkowitz introduced Bill No. 6982, to approve a lot consolidation plat for 8220-8260 Forsyth Blvd to be read for the first time by title only. Alderman McAndrew seconded.

City Attorney Karr reads Bill No. 6982, first reading, an Ordinance Providing for the Approval of a Plat to Consolidate Certain Property Addressed 8220 and 8260 Forsyth Boulevard in the City of Clayton, Missouri by title only.

The motion passed unanimously on a voice vote.

Motion made by Alderman Berkowitz that the Board give unanimous consent to consideration for adoption of Bill No. 6982 on the day of its introduction. Alderman McAndrew seconded.

The motion passed unanimously on a voice vote.

Alderman Berkowitz introduced Bill No. 6982, to approve a lot consolidation plat for 8220-8260 Forsyth Blvd to be read for the second time by title only. Alderman McAndrew seconded.

City Attorney Karr reads Bill No. 6982, second reading, an Ordinance Providing for the Approval of a Plat to Consolidate Certain Property Addressed 8220 and 8260 Forsyth Boulevard in the City of Clayton, Missouri by title only.

The motion passed on a roll call vote: Alderman Berkowitz – Aye; Alderman McAndrew – Aye; Alderman Buse – Aye; Alderman Feder – Aye; Alderman Hummell – Aye; and Mayor Harris – Aye. The bill, having received majority approval, was adopted, and became Ordinance No. 6841 of the City of Clayton.

ORDINANCES FOR REZONING, A PLANNED UNIT DEVELOPMENT AND A MINOR SUBDIVISION PLAT FOR 201-215 NORTH MERAMEC AVENUE AND 8015 PERSHING AVENUE

Mayor Harris opened the public hearing and requested proof of publication.

City Manager Gipson reported that this request is for a Public Hearing for review and consideration of the rezoning and related Planned Unit Development for a proposed mixed- use development. The rezoning, Planned Unit Development, and Subdivision Plat are being addressed together in this report, though the plat and the land use elements entail separate ordinances on the Board’s agenda.

The project received Architectural Review Board approval and the Plan Commission recommended approval of the Site Plan, Lot Consolidation, Rezoning and Development Plan on June 5, 2023.

Jason Braidwood, Developer, was in attendance to answer questions.

Joel Fuoss, Trivers Architect, was in attendance to answer questions.

Carolyn Hentschell, resident, commented on the proposed project.

Anna Krane, Director of Planning, was in attendance to answer questions.

Chris Schmiz, Clayton Equity Committee, addressed the Board expressing appreciation to all involved and including affordable housing in the project.

Tom Lucas, 8010 Pershing, addressed the Board expressing appreciation for all the City has done. He requests that the City provide quick approvals during the process in order to minimize the construction period.

Meramec Avenue and 8015 Pershing Avenue to a Planned Unit Development District known as the Meramec-Pershing Planned Unit District to be read for the first time by title only. Alderman McAndrew seconded.

The motion passed unanimously on a voice vote.

Motion made by Alderman Berkowitz to approve the Consent Agenda. Alderman McAndrew seconded.

APPOINTMENT OF CRAIG H. SMITH AS MUNICIPAL PROSECUTOR

City Manager Gipson reported that a panel consisting of Police Chief Mark Smith, Director of Planning and Development Services Anna Krane, Clayton resident and attorney Anna Etzkorn, and I interviewed both candidates on June 26, 2023. Following the interviews and deliberation, the panel unanimously recommended the selection of Craig Smith for the position.

Motion made by Alderman Berkowitz to approve the appointment of Craig H. Smith as the City of Clayton Prosecuting Attorney. Alderman McAndrew seconded.

The motion passed unanimously on a voice vote.

APPOINTMENT OF MUNICIPAL JUDGE

Alderman Berkowitz reported that on Tuesday, June 20, 2023, the Municipal Judge Selection Panel members - Judge Michael Jamison, Attorney William Wallace, Shantay Bolton, Clayton Equity Commission, and himself engaged in interviews with three candidates.

On Friday, June 23, 2023, the Panel met to discuss, evaluate, and make its recommendation to the Board. The Panel has recommended Stephen M. Strum to be appointed as Judge of the Clayton Municipal Court for the upcoming term.

Motion made by Alderman Berkowitz to appoint Stephen M. Strum as the Municipal Judge for the City of Clayton. Alderman McAndrew seconded.

The motion passed unanimously on a voice vote.

Other

Alderman Berkowitz reported on the following: • Economic Development Advisory Committee (EDAC) o reviewed the proposed Special Business District FY2024. o recommended allocating monies for events and entertainment venues.

Alderman McAndrew reported on the following: • Plan Commission meeting – the original Forsyth/Central project has been revised and now the developer is proposing a hotel. • CRSWC Finance Committee o reviewed the budget and made salary adjustments. o discussion on the cost increases for utilities, commodities, etc.

Alderman Buse reported on the following: • Sustainability Committee o discussion on reducing the carbon footprint o grants (Ameren – four charging stations; hydration stations) o Washington University intern o discussion on recommending proposing an ordinance for idling o discussion on recommending an ordinance on gun safety

Alderman Feder reported on the following: • Clayton Equity Committee o Member Shantay Bolton, accepted a position with Georgia Tech. o Ben Uchitelle stepped down as Chairman and Chris Schmiz was appointed

Alderman Hummell reminded the Board of the Washington University Community meeting being held June 29 at Clayton High School
