Adoption of the Local Compliance Plan for the Division of Special Education (ECSE) November 19, 2025
Summary The Board of Education is asked to provide its annual approval of the compliance plan that governs the special education services offered at the early childhood level. This approval is required to continue to offer these services in the early childhood program. The Department of Elementary and Secondary Education has developed a Model Compliance Plan that, if adopted by the district, meets the compliance requirements for the state. This Model Compliance Plan is seen as reflective of best practice in special education delivery of services.
Description of Agenda Item Each year, the School District of Clayton must assure the Department of Elementary and Secondary Education (DESE) of the state of Missouri that it is in compliance with the provisions of the Missouri State Plan for Special Education. Annually, the district adopts the Model Compliance Plan made available by DESE as a means of guaranteeing local compliance with state and federal guidelines for special education. This compliance is necessary, as Clayton offers its own Early Childhood Special Education program. Compliance at grade levels K-12 is assured through the district’s relationship with Special School District.
Background Information Annually, the School District of Clayton must assure that its special education practices and procedures are consistent with state and federal guidelines. The district may choose one of three options:
Option A: Adopt the Model Compliance Plan made available by the Department of Elementary and Secondary Education Option B: Adopt the Model Compliance Plan with agency (district) revisions Option C: Agency (district) developed Compliance Plan
Option A is accepted as reflective of exemplary standards in special education, and thus is the option recommended for adoption.
Recommendation Adopting the Model Compliance Plan assures that the School District of Clayton is offering special education services at the early childhood level in a manner that is consistent with state and federal guidelines. The Model Compliance Plan developed by the Department of Elementary and Secondary Education represents best practice in special education practices and procedures.
Motion (if action is required) That the Board of Education approves the Local Compliance Plan for the Division of Special Education for 2025-2026 as its assurance that its special education services in the early childhood program comply with all state special education policies and regulations.
