Policy BDC: Closed Meetings, Records, and Votes - Second Reading February 5, 2025
Summary Policy is how a board sustainably exercises power to serve students. Through policy, school boards establish a set of cohesive guidelines able to move from vision into reality. The Board of Education of the School District of Clayton is being asked to adopt the policy updates provided by the Missouri School Boards Association (MSBA).
Description of Agenda Item The purpose of this agenda item is to update the policy with the proposed changes related to closed board meeting agendas.
Background Information Several times a year, the Missouri School Boards Association (MSBA) provides to its partner districts updates to its policies. Updates to policies are typically the result of state and/or federal legislation that then leads MSBA to offer mandatory or recommended changes to District policies. MSBA modified this policy to reflect the amendments made to the Sunshine Law under HB2111. The new language expands the state auditor’s authority to audit political subdivisions, such as school districts, for “improper government activity.” This term is defined very broadly and even though MSBA believes that the intent of this statute was to allow the state auditor to close complaints made by citizens, it is possible that this provision can apply to school districts as well. For that reason, MSBA is including this amendment in this policy. MSBA has also included an existing provision regarding the confidentiality of foster home or kinship placements made by the Missouri Department of Social Services. Because districts serve many foster care students, this provision is relevant to this policy. In addition, the statutory references in this policy will be updated as well.
