MINUTES CITY PLAN COMMISSION/ARCHITECTURAL REVIEW BOARD March 6, 2023 CITY HALL CHAMBERS/ZOOM MEETING
The City Plan Commission/Architectural Review Board of the City of Clayton, Missouri, met on the above date at 17:30 hours at the CITY HALL CHAMBERS/via ZOOM meeting. Upon roll call, the following responded:

Regular meeting of 2/21/2023
Carolyn Gaidis motioned to approve as submitted. Helen DiFate seconded the motion. The motion carried unanimously.
PUBLIC HEARING 1. Chapter 405 Zoning Regulations and Chapter 410 Overlay and Urban Design Zoning Districts - Marijuana Regulations – Text Amendment Consideration of text amendments to align the City’s Land Use Code with Article XIV of the Missouri Constitution related to marijuana and medical marijuana.
The public hearing opened at 17:31. Anna Krane provided a summary of the staff report. PC-ARB and staff discussed the item. No comment was provided by the public. The public hearing closed at 17:39. Carolyn Gaidis made a motion to recommend approval of the text amendment to the Board of Alderman. Helen DiFate seconded the motion. The motion carried unanimously.
NEW BUSINESS 1. 8009 Watkins Drive – Architectural Review Board – Alteration/Exterior Renovation Consideration of a request by Christa Taylor, Applicant, on behalf of Alem Boric and Danijela Marjanovic, Owner, for review of design and materials for a new retaining wall.
Ryan Helle provided a summary of the staff report with a recommendation to approve with the
following condition: 1. The applicant shall select a retaining wall material that complies with the architectural review guidelines and submit the material to staff for administrative approval. Christa Taylor, the applicant, was present. PC-ARB discussed the item with the applicant. Carolyn Gaidis made a motion to approve on the condition that an alternative color be chosen for the retaining wall. PC-ARB discussed the motion. Carolyn Gaidis withdrew the motion. Bridget McAndrew motioned to approve as submitted. Carolyn Gaidis seconded the motion. The motion carried with five votes in favor and one vote opposed.
2. 33 North Central Avenue – Plan Commission - Restaurant Conditional Use Permit Consideration of a request by Bridget Holton, Applicant, on behalf of NF Missouri LLC, for review of a Conditional Use Permit for Native Foods, a fast causal restaurant.
Ryan Helle provided a summary of the staff report with a recommendation to recommend approval to the Board of Alderman. No representative was present on behalf of the application. Carolyn Gaidis made a motion to recommend approval to the Board of Alderman. Helen DiFate seconded the motion. The motion carried unanimously.
3. 21 & 21A Dartford Avenue – Plan Commission – Minor Subdivision Plat Consideration of a request by Kenneth Schaeffler, Applicant, on behalf of Robert Slavin, Owner, for review of the consolidation of Lots 8 and 9, Block 9 of the Hillcrest Subdivision.
Ryan Helle provided a summary of the staff report with a recommendation to approve with the following condition: 1. The applicant shall file a plat with the St. Louis County Recorder of Deeds and submit proof of filing to the City within 30 days of Board of Alderman approval. Kenneth Schaefer, applicant, was present. PC-ARB discussed the item with the applicant. Stan Mulvihill attended on behalf of the trustees of Hillcrest and discussed alternatives to the consolidation with PC-ARB and staff. Carolyn Gaidis made a motion to recommend approval to the Board of Alderman with the following condition: 1. The applicant shall file a plat with the St. Louis County Recorder of Deeds and submit proof of filing to the City within 30 days of Board of Alderman approval. Helen DiFate seconded the motion. The motion carried unanimously.
4. 28 Brentmoor Park – Site Plan Review – Regrading Project Consideration of a request by Gregory Zipfel, Applicant/Owner, for review of regarding and landscape alterations in the rear yard.
Ryan Helle provided a summary of the staff report with a recommendation to approve on the following condition: 1. Tree protection and other measures identified by the City’s contracted landscape architect shall be installed and maintained per the mark-up drawing dated February 5, 2023. Gregory Zipfel, applicant, was present. The PC-ARB discussed the item with the applicant. Darin Girdler, University City Director of Public Works, was present and discussed impact from the perspective of University City. Carolyn Gaidis made a motion to approve on the following conditions: 1. Tree protection and other measures identified by the City’s contracted landscape architect shall be installed and maintained per the mark-up drawing dated February 5, 2023. 2. That the heights of the evergreen trees to be installed on the north border shall be ten feet in height. Helen DiFate seconded the motion.
OLD BUSINESS 1. 48 South Bemiston Avenue, 7745 & 7751 Carondelet Avenue – Plan Commission - Rezoning Continuation of a public hearing considering a request by Philip Hulse of Green Street Bemiston Investors, LLC, Applicant/Owner, for review of rezoning the subject properties from High Density Commercial District to a Planned Unit Development. 2. 48 South Bemiston Avenue, 7745 & 7751 Carondelet Avenue - Planned Unit Development – New Mixed-Use Continuation of a public hearing considering a request by Philip Hulse of Green Street Bemiston Investors, LLC, Applicant/Owner, for consideration of the terms and conditions of the proposed Planned Unit Development. 3. 48 South Bemiston Avenue, 7745 & 7751 Carondelet Avenue - Architectural Review - New Mixed-Use Consideration of a request by Philip Hulse of Green Street Bemiston Investors, LLC, Applicant/Owner, for review of design and materials associated with a proposed mixed-use office, retail, and residential tower. 4. 48 South Bemiston Avenue, 7745 & 7751 Carondelet Avenue - Site Plan Review – New Mixed- Use Consideration of a request by Philip Hulse of Green Street Bemiston Investors, LLC, Applicant/Owner, for site plan review of a proposed mixed-use office, retail, and residential tower. 5. 48 South Bemiston Avenue, 7745 & 7751 Carondelet Avenue – Plan Commission – Major Subdivision Plat Consideration of a request by Philip Hulse of Green Street Bemiston Investors, LLC, Applicant/Owner, for review of the consolidation of Lots 1, 2, 3, and 4, Block 13 of the Town (now City) of Clayton and widening of the east-west alley.
Steve Lichtenfeld notified PC-ARB and attendees that the items for 48 South Bemiston Avenue and 7745-7751 Carondelet Avenue would be discussed at a later meeting. Carolyn Gaidis made a motion to continue the item. Helen DiFate seconded the motion. The motion carried unanimously.
