MINUTES BOARD OF ADJUSTMENT FEBRUARY 2, 2023 ROLL CALL

Chairman Gary Soule called the meeting to order at 5:00 pm.

Minutes from November 3rd, 2022 were presented for approval. Board members noted corrections needed. Rick Bliss made a motion to approve the minutes with corrections. Liza Streett seconded the motion. The motion carried unanimously.

1. An appeal from Robert Slavin, Applicant/Owner, of 21 Dartford Avenue, for the following variance from the City of Clayton’s Zoning Regulations:

A 7.5 foot variance from the required rear yard setback of 37.5 feet, Section 405.1900.A.2 of Article XIII “R-2” Single-Family Dwelling District, to allow for the construction of a new single-family home located 30 feet from the rear (west) property line. Ken Scheffler, applicant, was present. The board discussed the item with the applicant. Public comment was received from Bull Schulte, Hillcrest Trustee. The applicant chose to withdraw the application prior to a vote.

2. An appeal from Axton McCormack, Applicant, on behalf of Angela and Stephen Strum, owners of 8177 Stratford Drive for the following variance from the City of Clayton’s Zoning Regulations to allow for the construction of a rebuilt deck with covered roof on northern portion of deck:

A 10 percent variance from the maximum impervious lot coverage of 55 percent, Section 410.350.A.1 and Section 410.375.B.1.b of

Article VII Clayton Gardens and Clayshire Subdivision (“R-2”) and Clayton Gardens (R-4) Urban Design Zoning Districts to allow for a total lot coverage of 65 percent. Axton McCormick, applicant, and Steve Strum, Owner, were present. The board discussed the item with the applicant and owner. Lynn and David Phillips provided public comment. Rick Bliss made a motion to approve the variance as requested. Liza Street seconded the motion. The motion did not carry with no members voting in favor and all members voting opposed. The meeting adjourned at 7:05 pm.
