BOARD OF ADJUSTMENT

CHAIRMAN GARY SOULE called the meeting to order at approximately 17:07.
MEETING MINUTES OF AUGUST 5, 2021 WERE APPROVED WITH MINOR CORRECTIONS.
Appeal from Colby and Rachel Parks for a 5 foot 2 inch variance from the required front yard setback of 29 feet 3 and 19/32 inches to allow for the construction of an addition to the east side of the existing home, located 24 feet 1 and 19/32 inches from the front property line (Section 405.1900.A.1). 922 DeMun Avenue.
All those wishing to speak were sworn in by Darla Thompson, Court Reporter.

Chairman Soule asked if the City had any exhibits to present with regards to this appeal.
Kevin O’Keefe presented the following exhibits:
City of Clayton Code of Ordinances and City’s Master Plan Title 4, Chapter 400 Zoning Regulations Article VI, Sections 405.570-720

Section 405.1900.A.1. of City Code Zoning Review Application Denial Letter Appeal Petitioner filed City’s files, plans and records pertaining to the application and staff report to this Board
Kevin O’Keefe – recognized the receipt of letters of support for the petition in an email dated August 26, 2021 and consisting of comments from 3 different neighbors expressing their support for the requested variance. He also noted the City has no objection to these exhibits.
Chairman Soule – Asked if the applicant had any objections to the City’s exhibits.
Colby and Rachel Parks – No objections.
Chairman Soule – noted the City’s exhibits will be included in the record.
Chairman Soule – recognized letters of support received in an email dated August 26, 2021 from 3 different neighbors expressing their support for the requested variance. Assigned as applicant’s exhibit 1.
Kevin O’Keefe noted no objection to applicant’s exhibit 1.
Colby Parks – made a presentation regarding the request for variance.
Wynne Yellen, Architect – introduced himself.
Chairman Soule – questioned Annisa Kumerow, Principal Planner and Kevin O’Keefe, City Attorney.
Public Speakers:
Sally Hezel, 6233 San Bonita Avenue – was sworn in and commented on the request.
Chairman Soule commented on Sally Hezel’s concern over precedent.
Kevin O’Keefe – commented on Chairman Soule’s explanation of precedent.
Julie Dorfman, 6347 Alamo Avenue – was sworn in and commented on the request.
Chairman Soule – asked for a motion for the requested variance on the application.
Liza Streett – moved to approve a 5 foot 2 inch variance from the required front yard setback of 29 feet 3 and 19/32 inches to allow for the construction of an addition to the east side of the existing home, located 24 feet 1 and 19/32 inches from the front property line per Section 405.1900.A.1.
Anne Bishop seconded motion.
Roll call taken and variance approved unanimously (5-0).

Motion to adjourn was made by Liza Streett and Anne Bishop seconded the motion. The motion was approved unanimously, and the meeting adjourned at 17:50.
