MINUTES BOARD OF ADJUSTMENT FEBRUARY 07, 2019

CHAIRMAN SOULE called the meeting to order at approximately 1703. He noted that there is one item for consideration this evening.
The minutes of the January 03, 2019 meeting were presented for approval.
LIZA STREETT – Motion to approve minutes from 01/03/2019 as submitted.

APPEAL FROM OWNERS LILY AND CHARLES VOELLINGER FOR TWO VARIANCES, 8 FEET FROM THE FRONT YARD SETBACK AND 26.3 FEET FROM THE REAR YARD SETBACK

CHAIRMAN SOULE asked if the City had any exhibits to present with regards to this appeal.
CITY ATTORNEY HEINZ presented the following exhibits:
A. City of Clayton Code of Ordinances & Master Plan B. Application for Zoning Review & Zoning Review Denial Letter C. Application for Appeal D. Property Survey Site Plan, and elevation submitted by applicant E. Staff Report
CHAIRMAN SOULE – The City’s exhibits A – E will be included in this record. Asks for applicant representative to come forward and begin by stating name.
CHARLES VOELLINGER (CV) – 606 East Polo Drive.

CV – Explains this is a reapplication. Three years ago, this variance was granted and then some things came into play and they backed off the project. Since then they have come back and scaled down the project. There is an error on the variance request it would be 27.3-foot variance instead of 26.3. It would allow them to park in their driveway and get them out of the street. The neighbors are very supportive of the plans and getting their cars off the street.

BOARD ASKS VARIETY OF QUESTIONS TO Staff regarding extreme hardship or severe practical difficulties existing based upon the shape of the lot, topography, or other natural situations not the fault of the applicant.
*STAFF RESPONDS ACCORDINGLY WITH ANALYSIS STATED IN THE STAFF REPORT. *
BOARD ASKS VARIETY OF QUESTIONS: To the applicant including questions relating to alternate options and if they were considered by the applicant.
CV – Explains the alternative options listed on the application and why they would not work out. The application was provided to the Board.
BOARD ASKS VARIETY OF QUESTIONS to Staff regarding if the variance request can be increased to 27.3 feet. Staff says that it is acceptable if that is the variance the architect is requesting and says they need, you are allowed to approve that increase request.
Hearing no further questions or comments, Chairman Soule called for a motion.
RICK BLISS (RB) – I move that we approve an 8-foot variance from the required front yard setback of 18 feet along Hanley Road (Section 405.1900.1); and a 27.3-foot variance from the required rear yard setback of 43.3 feet (Section 405.1900.2).
