An appeal from Marc and Lvav Spector, Applicants/Owners, of 8028 Orlando Avenue for the following variance from the City of Clayton’s Zoning Regulations to allow for the construction of an enclosed screen porch on site of current deck:
A 7.0 foot variance from the required rear yard setback of 30.0 feet, Section 405.1900.A.2 of Article XIII “R-2” Single-family Dwelling District.
All those wishing to speak were sworn in by Chairman Soule

Chairman Soule asked if the City had any exhibits to present with regards to this appeal.
Kevin O’Keefe presented the following exhibits:
City of Clayton Code of Ordinances & Master Plan Application for Zoning Review & Zoning Review Denial Letter Application for Appeal Property Survey Site Plan, and elevation submitted by applicant Staff Report Files plans and records pertaining to the subject property
Chairman Soule – Asked if the applicant had any objections to the City’s exhibits
LS – No objections.
Chairman Soule – NOTED the City’s exhibits will be included in this record.
LS – made presentation regarding request for variance application for her property.
Discussion from Board questioning the variance’s applicability to future improvements of the screen room.
Kevin O’Keefe – suggested deed restriction as could be placed on property pursuant to the potential approval of the variance and noted the variance requested is for this specific application (screen room) and not applicable to any future redevelopment of the screen room.
RK/LS – noted future use for something other than a screen room is not planned.
RICK BLISS- I MOVE TO APPROVE conditioned on the filing of a deed restriction stipulating the approval as predicated on a screen porch and not permanent windows or walls, throughout, of a 7 foot variance from the required rear yard setback of 30 feet to allow a screen porch located 23 feet from the rear property line pursuant to 405.1900.A.2 for property located at 8028 Orlando Drive
