Chairman Gary Soule called the meeting to order at 5:05 pm.

Meeting minutes of December 2, 2021, were approved with minor corrections.

An appeal from Tom Lewis, Lewis Contracting, Applicant, on behalf of Brian Pultman, Owner of 29 Southmoor Drive, for the following variance from the City of Clayton’s Zoning Regulations to allow for the construction of a free-standing pavilion.

A 0.52-foot variance from the accessory structure setback of 5 feet from the side property line, Section 405.1730(A)(3)(c). of Article XIII “R-2” Single-Family Dwelling District

Brian Pultman, Property Owner, was present Tom Lewis of Lewis Contracting, Applicant, was present Peter Conant of Conant Design, Architect, was present

Chairman Soule informed the applicant and owner that the full board was not present and, if they preferred, could continue their appeal to a later date. The applicant and owner elected to proceed as scheduled. Chairman Soule swore in all witnesses. On behalf of the city, Kevin O’Keefe offered the following exhibits into the record which were admitted without objection: Exhibit A – City Code of Clayton MO Exhibit B – Article VI, Sections 405.570-405.720, Powers of the Board of Adjustment Exhibit C – Article XIII of Sections 405.1830 and Chapter 405.1490 of Chapter 405 Regulation of R2-Zoning Exhibit D – Section 405.1738.A.3.C Setbacks for R2-Zoning Exhibit E – Application to Board of Adjustment for an Area Variance Exhibit F – Files and records from the City of Clayton for 29 Southmoor Drive Exhibit G – Staff Report Exhibit H – Files of Planning Department including Denial Letter Chairman Soule submitted an email from the neighbors at 27 Southmoor indicating approval of the requested variance. Brian Pultman, Peter Conant, and Tom Lewis presented to the Board. The property owner began construction of a pavilion but found errors during their survey. The property owner is seeking a variance to be able to finish the construction of the pavilion. The Board asked questions to the property owner, applicant, architect, and planning staff. Liza Streett made a motion for a 0.52-foot variance from the accessory structure setback of 5 feet from the side property line, Section 405.1730(A)(3)(c). of Article XIII “R-2” Single-Family Dwelling District. Mary DeBenedetti seconded the motion. The board approved unanimously. The meeting adjourned at 5:59 p.m.
