Chairman Soule asked if staff anticipates that granting this variance would not have a detrimental impact on light or air to neighboring property.
Anna Krane replied “correct”.
Chairman Soule asked about alternatives.
Ms. Kalkwarf stated that they have a bay that would have to be modified if the deck met setback requirements and that a smaller deck would not be able to accommodate a table and chairs.
Hearing no further questions or comments, Liza Streett made a motion to approve the variances as requested [a 5-foot variance from the side yard setback of 5-feet and a 6.15-foot variance from the maximum rear yard setback allowance {for an uncovered deck} of 21.5-feet] to allow the construction of a deck at the subject property. The motion was seconded by Anne Bishop and unanimously approved by the Board.
Chairman Soule asked staff if there will be a meeting in August.
Anna Krane replied “no”.
Being no further business for this Board of Adjustment this evening, the meeting adjourned at 6:00 p.m.

Rick Bliss asked how long they expect construction to take.
Mr. Ringwald’s reply was “one year”.
Chairman Soule asked when they plan on starting demolition.
Mr. Ringwald indicated that they plan to demo soon and begin construction in early fall.
Hearing no further questions or comments from the Board, Rick Bliss made a motion to grant a 3-foot variance from the required rear yard setback of 20-feet to allow the new building to be located 17-feet from the rear property line. The motion was seconded by Anne Bishop and unanimously approved by the Board.
Jane Motozian, 119 North Bemiston Avenue, asked about the mechanical equipment and lighting; she asked to see the site plan.
Mr. Ringwald showed Ms. Motozian the site plan.
Anna Krane informed Ms. Motozian that the Plan Commission and Architectural Review Board will be reviewing and voting on the site plan and architectural aspects of the project at a meeting to be held in the future.
Chairman Soule informed Ms. Motozian that this Board has very limited authority and only considers variance requests.
Anna Krane announced that once applications and plans have been submitted for the site plan and architectural review, they will be posted to the City’s website and notice of the meeting will be mailed to property owners within 200 feet.
Ms. Motozian asked if the applicant would be willing to meet with neighbors.
Mr. Ringwald replied “yes”.

Steven Marlow, 115 North Bemiston Avenue, stated that his concerns regarding height would not be a consideration at this meeting this evening. He stated that he would love to be made aware of this proposal.
Chairman Soule apologized for not soliciting citizen/audience comments before the vote and asked if any of the members desired to modify their vote after hearing comments.
No modification was requested. Chairman Soule announced that the motion and vote will stand.
APPEAL FROM JEANNINE & KENT KALKWARF REGARDING THE PROPERTY AT 168 NORTH CENTRAL AVENUE (A 5-FOOT VARIANCE FROM THE REQUIRED SIDE YARD SETBACK OF 5-FEET AND A 6.15-FOOT REAR YARD VARIANCE FROM THE MAXIMUM REAR YARD SETBACK ALLOWANCE OF 21.5-FEET [FOR UNCOVERED DECKS] TO ALLOW A NEW DECK TO BE LOCATED 15-FEET FROM THE REAR PROPERTY LINE AND ALONG THE SIDE PROPERTY LINE.
Jeannine and Kent Kalkwarf were in attendance at the meeting.
Chairman Soule asked if the City had any exhibits to present with regard to this appeal.

Mr. Kalkwarf replied “no”.
Ms. Kalkwarf informed the members that the deck is in disrepair and that they learned of this encroachment after they applied for a permit to replace the deck. She stated the new deck will be in the same footprint as the existing deck. She noted that the two houses touch (referring to their house and the house addressed 166 North Central Avenue). She asked the Board to approve this request as it will be a newer, safer deck that will match the fence. She informed the members that her eastern neighbors are okay with their proposal and that they’ve talked to the Travis’ at
